1 Acceptance of These Terms
This document, along with our rules, policies, and referenced documents, constitutes our Terms of Service ("Terms"). These Terms establish a legally binding contract between you and Buzzly.art, outlining your rights and responsibilities when using our website. Please read them carefully.
2 Changes
Buzzly.art reserves the right to amend the Terms at any time by posting a revised version on our website. The revised version will become effective upon posting. In the event that changes to the Terms reduce your rights or increase your responsibilities, we will provide you with prior notification.
3 Access
You are granted a non-exclusive, limited, and revocable license to access the website and use its functionality, subject to the following conditions:
- i. You are at least 13 years of age.
- ii. You use the website solely for lawful purposes.
- iii. You do not create an account with an improper or racist username.
- iv. You do not create an account with false or misleading information.
- v. You do not engage in derogatory, racist, sexist, harmful, or demeaning behavior.
- vi. You comply with all relevant laws in your jurisdiction.
- vii. You do not use your account to impersonate individuals or organizations.
- viii. You do not create accounts to reserve usernames.
- ix. You do not harass, target, or threaten other members.
- x. You do not encourage or promote self-harm to other members.
- xi. You do not encourage or promote sexual violence, rape, or illegal acts.
- xii. You do not promote terrorist organizations.
- xiii. You do not post links to prohibited content.
- xiv. You do not create spam or mass message users.
- xv. You do not publish other people's private information (doxxing).
- xvi. You do not participate in or promote gambling.
- xviii. You do not violate intellectual property rights.
- xix. You do not spread misinformation or fake news.
- xx. You adhere to our Upload Policy and Copyright Policy.
4 Your Details and Visits
By using this website, you acknowledge and consent that your information and personal details will be processed in accordance with our Privacy Policy. You agree to the processing of this information and confirm the accuracy and truthfulness of all details provided by you.
By using Buzzly's Services, you accept and grant us all rights and permissions to host, distribute, display, and create derivative works of your uploaded content (including thumbnail creation and resizing). These permissions do not transfer author rights to your submissions and are solely used to enable us to provide our services.
5 Prohibited Uses
You are prohibited from using, encouraging, promoting, facilitating, instructing, or inducing others to use the website or its services for any activities that violate our terms of service or any applicable laws. You may not use the website to engage in illegal, fraudulent, or harmful activities.
6 Registration & Security
6.1 - To access the Service, you may be required to provide certain registration details. Your use of the Service is conditional upon providing correct, current, and complete information governed by our Privacy Policy.
6.2 - As a condition of using the Service, you may be required to register with Buzzly.art, select a username and password, or provide additional contact information ("User ID"). You must provide accurate, complete, and current User ID information.
6.3 - You are responsible for maintaining the confidentiality of your User ID and must not share it with anyone. You may not transfer your account without prior written consent.
7 Enforcement
7.1 - Notices
Notices sent by our Staff are primarily intended to inform you of site moderator actions and are non-threatening. If you have issues with a staff member, please contact us.
7.2 - Strikes
Reports determined to be violations will be treated as strikes:

7.3 - Escalation
Violating points (i, ii, v, ix, x) from section 3 will result in a level 4 strike or above and may result in a permanent ban.
7.4 - Evading Suspension
Creating additional accounts to circumvent bans or blocks will result in a permanent ban.
7.5 - Ban Appeals
You may appeal actions by sending an email to contact@buzzly.art.
8 Termination
8.1 - Buzzly.art reserves the right to change, suspend, limit, or discontinue any services at any time without notice (unless required by law).
8.2 - Buzzly.art may refuse service to anyone and may terminate or suspend your access at any time without notice (unless required by law).
9 Limitations
In no event will Buzzly.art be liable to you for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the website, whether based on warranty, contract, tort, statute, or any other legal theory.
10 Indemnification
You agree to defend and indemnify Buzzly.art against any claim, liability, damage, loss, and expense arising out of: (i) your use of the website; (ii) your violation of these Terms; (iii) your violation of any third-party right; or (iv) any dispute between you and any third party.
11 Entire Agreement
This Agreement constitutes the entire agreement between the parties with respect to the subject matter herein and supersedes all prior agreements.
12 Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the United Mexican States and international treaties.
13 Messaging & Communications
13.1 - Buzzly provides a messaging feature that allows users to communicate with each other. Messages are subject to the same rules and conduct standards that apply to all other content on the platform, including the prohibited uses outlined in Section 3 and Section 5.
13.2 - Messages are not end-to-end encrypted. Buzzly staff may review message content when a report is submitted by a participant, when required by law, or when investigating violations of these Terms. We do not proactively monitor private messages.
13.3 - You agree not to use the messaging feature to:
- i. Send unsolicited messages, spam, or commercial solicitations.
- ii. Harass, threaten, or intimidate other users.
- iii. Share, solicit, or distribute illegal content of any kind.
- iv. Attempt to solicit personal information from minors.
- v. Coordinate or plan activities that violate these Terms or any applicable law.
- vi. Circumvent user privacy settings, blocks, or messaging restrictions.
13.4 - Messages are automatically and permanently deleted after 6 months. Buzzly does not offer message recovery after deletion. You are responsible for saving any information you wish to retain.
13.5 - Buzzly reserves the right to restrict messaging access for new accounts, accounts without verified email addresses, or accounts that have been flagged for abuse. Messaging limits (such as rate limits and daily conversation caps) may be applied to prevent spam and abuse.
13.6 - Buzzly will cooperate with law enforcement authorities and comply with valid legal requests (such as court orders and subpoenas) to disclose message content. Where illegal activity is discovered through reports or moderation, Buzzly may proactively report such activity to the appropriate authorities.
15 Artificial Intelligence & Content Use
15.1 - Your submissions, comments, messages, profile information, and any other content you upload to Buzzly will never be used to train, fine-tune, or develop artificial intelligence models, machine learning systems, large language models, image generation models, or any similar technology β whether by Buzzly, its affiliates, or any third party.
15.2 - Buzzly will not enter into any agreement, partnership, or arrangement that would grant third parties access to user content for the purpose of AI or machine learning training.
15.3 - Automated scraping, crawling, or bulk downloading of user content from Buzzly is strictly prohibited. Buzzly reserves the right to take technical and legal action against any entity that engages in unauthorized data collection from the platform.
15.4 - This prohibition applies to all content, regardless of its visibility settings (public or private), and survives any termination or modification of these Terms.
